Terms of Use

1. The Services

Coffee Exchange is a coffee shop format with dynamic drink prices. The app lets you follow prices, place orders, buy coupons and take part in the loyalty program. The Services run on Claos, a software platform developed by the Company. Drinks and food are sold by Coffee Exchange coffee shops, including franchise partners; the seller is shown when you place an order.

2. Account

To use the app you need to register with a phone number. You agree to provide accurate information, not to give access to your account to third parties and to tell us if someone else has gained access to it. One person may have one account.

3. Prices, coupons and Beans

• Drink prices depend on demand and move during the day within a set corridor. The price is fixed at the moment you pay for an order or a coupon.
• A coupon is a prepaid drink at a locked price. Its validity period is shown in the app. Coupons are not financial instruments and cannot be exchanged for money, except for refunds provided for by law.
• Beans are the internal units of the loyalty program. They are added and redeemed under the rules published in the app, are not money and cannot be exchanged for cash.
• Beans and coupons obtained by mistake or as a result of abuse may be cancelled.

4. Acceptable use

You must not:

• use the Services for unlawful purposes;
• attempt to gain unauthorized access to the Services or to other users’ data;
• interfere with the operation of the Services or use automated means to influence prices or obtain Beans;
• decompile the apps, except where permitted by law.

5. Intellectual property

Exclusive rights to the apps, the website, the Claos name, the design and the software code belong to the Company or its licensors. You are granted a simple (non-exclusive), non-transferable license to use the apps for personal, non-commercial purposes.

6. App stores

If you downloaded the app from the App Store or Google Play, you also follow the rules of that store. Apple and Google are not parties to these Terms and are not responsible for the app or its support.

7. Availability and changes

We aim to keep the Services running without interruption but do not guarantee the absence of downtime or errors. We may update, change or discontinue individual features and will give advance notice of material changes where possible.

8. Liability

The Services are provided “as is”. To the extent permitted by law, the Company is not liable for indirect losses or for the actions of coffee shops when they sell goods and provide services. Nothing in these Terms limits the consumer rights guaranteed by law.

9. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate access if these Terms are breached, and we will notify you. When an account is deleted, unused Beans are cancelled; active coupons should be used before deletion.

10. Personal data

How we process personal data is described in the Privacy Policy.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of Kazakhstan. Disputes are resolved through negotiation and, failing agreement, in the courts of the Republic of Kazakhstan in accordance with the law.

12. Changes to these Terms

We may update these Terms. A new version takes effect once it is published on this page. We will notify you of material changes in the app. Continuing to use the Services after the changes means you accept the new version.
